These Terms of Service (“Terms”) govern your use of pitchrightbaseball.com and any coaching, programs, or content offered by Pitch Right Baseball (“we,” “us,” “our”). By using our site or services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old to submit an application or purchase a program. Athletes under 18 may participate only with the involvement and consent of a parent or legal guardian, who is responsible for the athlete’s participation.
2. Our Services
We provide online baseball pitching instruction, including video training, mentorship programs, and coaching calls. Applying does not guarantee acceptance into a program. We may decline or end any application or enrollment at our discretion.
3. Assumption of Risk and Medical Disclaimer
Pitching and athletic training involve physical risk, including the risk of injury. Our content is for general educational purposes and is not medical advice. Before starting any program, consult a physician, especially if the athlete has an existing injury, arm pain, or health condition. You and the athlete participate voluntarily and at your own risk, and you are responsible for training safely, using proper warm-ups and rest, and stopping if pain occurs.
4. No Guarantee of Results
Results such as increased velocity, accuracy, or playing opportunities vary by athlete and depend on effort, consistency, health, and other factors. We do not guarantee any specific outcome. Testimonials and examples are not typical or guaranteed results.
5. Payments and Refunds
Prices and payment terms are shown at checkout or provided during your consultation. [A money back guarantee is available to those who complete the first month of the initial 3 month commitment, watch, practice and submit videos on OnForm for review 3x/week, and are unsatisfied with their results.] You are responsible for any applicable taxes.
6. Intellectual Property
All videos, programs, drills, text, logos, and other materials are owned by Pitch Right Baseball and protected by law. Your purchase gives you a personal, non-transferable license to use the content for the enrolled athlete only. You may not copy, share, resell, record, or distribute our content without written permission.
7. Permission to Use Photos and Video
If you submit videos or photos of the athlete for review, you allow us to use them to provide coaching. We will not publicly share identifiable images or videos of the athlete without separate written permission from the parent or guardian.
8. Acceptable Use
You agree not to misuse our site, share your account access, harass others, or attempt to disrupt or gain unauthorized access to our systems.
9. Communications
By applying, you agree to be contacted as described in our Privacy Policy, including by phone, email, and text message.
10. Limitation of Liability
To the fullest extent permitted by law, Pitch Right Baseball and its owners, coaches, and partners are not liable for any indirect, incidental, or consequential damages, or for any injury arising from use of our services. Our total liability for any claim will not exceed the amount you paid us for the service at issue.
11. Disclaimer of Warranties
Our site and services are provided “as is” and “as available,” without warranties of any kind, to the extent permitted by law.
12. Governing Law
These Terms are governed by the laws of the State of [California], without regard to conflict of law rules. Any dispute will be handled in the courts located in [United States, CA].
